Terms of service
§ 1 Scope and General Information
(1) These General Terms and Conditions apply to all orders placed via the online shop "www.swissmilitarywatches.ch," which is operated by Chrono AG, a company under Swiss law, company ID CHE-499.962.482, Weissensteinstrasse 49, 4502 Solothurn, Switzerland. Chrono AG is the owner of the watch brand "Swiss Military" and is hereinafter referred to as "Swiss Military."
(2) These Terms and Conditions apply in the version valid at the time of the order to all deliveries between Swiss Military and consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
(3) Swiss Military displays the products in the online shop to the best of its knowledge. Color and shape variations due to technical screen display, as well as minor deviations from product descriptions, cannot be completely ruled out.
(4) The online shop is technically operated via the platform of Shopify International Limited.
§ 2 Contract Formation
(1) The display of products in the online shop does not constitute a binding offer, but rather a non-binding invitation to the customer to order goods. By placing an order, the customer makes a binding offer to conclude a purchase contract.
(2) The ordering process consists of the following steps: selection of goods and placement in the shopping cart, review of the shopping cart contents, entry of the delivery address, selection of the payment method, binding completion by clicking the "Place order" button. Confirmation of receipt of the order is sent immediately by automated email; this does not yet constitute acceptance of the contractual offer. The purchase contract is only concluded when Swiss Military sends a separate order confirmation or when the goods are dispatched.
(3) A subsequent change to the order is not possible after it has been received by the customer. The customer may contact Swiss Military to cancel an order that has not yet been processed and place a new order; the right of withdrawal pursuant to § 8 remains unaffected.
(4) If an ordered item is not available, the customer will be informed immediately by email and given the choice between waiting for availability or cancellation with a full refund.
(5) Swiss Military reserves the right to refuse orders or to limit order quantities in individual cases if there is a legitimate reason for doing so, in particular in the event of a justified suspicion of fraudulent orders or repeated false information regarding delivery or billing addresses. Swiss Military will inform the customer of this immediately.
(6) The current General Terms and Conditions can be accessed, saved, and printed at any time on our website. The contract text will also be sent to you by email together with the order confirmation.
§ 3 Prices and Payment Terms
(1) All stated prices are total prices and include statutory value-added tax and all other price components. In addition to the stated product price, shipping costs apply, the amount of which is determined as follows: For orders of EUR 199.00 or more (or the equivalent amount in CHF), delivery is free of charge. Below this amount, shipping costs are CHF 8.00 within Switzerland and EUR 19.99 for international shipping. The exact shipping cost will be shown separately in your shopping cart before you complete the order.
(2) For customers with a delivery address in Switzerland, prices are quoted and billed in Swiss francs (CHF); for customers with a delivery address in the European Union, in euros (EUR).
(3) For deliveries to countries outside the EU and Switzerland, additional import duties and taxes may apply, which are to be borne by the buyer. Further information is available from the relevant customs office.
(4) The following payment methods are available: PayPal, Twint, Shop Pay, Klarna, Google Pay, Apple Pay, Union Pay, Visa, Mastercard, American Express, Bancontact, iDEAL, each processed via Shopify Payments or the respective payment service providers.
(5) Payment due dates depend on the payment method selected:
| Payment Method | Charge Time |
|---|---|
| PayPal | Charged when payment is initiated; dispatch after payment confirmation |
| Twint | Charged when payment is initiated |
| Shop Pay | Charged when payment is initiated |
| Klarna | According to Klarna's separate payment terms |
| Google Pay / Apple Pay | Charged when goods are dispatched |
| Union Pay / Visa / Mastercard / Amex | Charged when goods are dispatched |
| Bancontact / iDEAL | Charged when payment is initiated |
(6) Swiss Military does not store any credit card data. Payment processing is carried out exclusively via the respective payment service providers, whose own terms and conditions and privacy policies apply in addition.
(7) If the customer is in default of payment, Swiss Military is entitled to assert the statutory consequences of default.
§ 4 Delivery
(1) Delivery is made to the address specified by the customer. For a minimum order value of EUR 199.00 or the equivalent in CHF, delivery is free of charge. Below the minimum order value, shipping costs are CHF 8.00 within Switzerland and EUR 19.99 for international shipping.
(2) Delivery time is 2–5 working days within Switzerland and the EU and 5–10 working days for international shipping. Delays caused by customs authorities or transport companies commissioned by Swiss Military as independent third parties do not constitute liability on the part of Swiss Military; liability of Swiss Military for its own shipping delays remains unaffected. If the delivery time cannot be met, the customer will be informed immediately and, if the new delivery date is not accepted, will have a free right of withdrawal with a full refund of the purchase price.
(3) As an alternative to delivery, the customer may collect the goods in person at the following address after prior confirmation by Swiss Military: Chrono AG, Weissensteinstrasse 49, CH-4502 Solothurn. In this case, the risk of accidental loss or accidental deterioration only passes to the customer upon actual handover of the goods at the collection point. The withdrawal period begins on the day the goods are actually taken into possession at the collection point.
(4) In the event of visible transport damage, it is recommended that this be reported immediately to the delivery agent and to Swiss Military. Failure to report does not affect the customer's statutory warranty rights.
§ 5 Retention of Title
The delivered goods remain the property of Swiss Military until full payment has been made.
§ 6 Customs for Deliveries Outside the EU/Switzerland
For orders with delivery outside the European Union, import duties may be incurred, which the customer must bear as the importer. Swiss Military has no influence on the amount of these duties.
§ 7 Customer Account
Customers can set up a customer account without a traditional password; access is via a one-time code sent by email. Orders already placed using the same email address are automatically assigned to the account and can be viewed there. A return can also be registered via the customer account (see § 8 and our Refund Policy).
§ 8 Right of Withdrawal for Consumers
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item.
To exercise your right of withdrawal, you must inform us
Swiss Military by Chrono, Chrono AG, Weissensteinstrasse 49, 4502 Solothurn, Switzerland, phone: +41 032 624 14 14, email: mail@swissmilitarywatches.ch
of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the sample withdrawal form below, but it is not mandatory. Alternatively, you can also register your withdrawal via your customer account.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.
You must return the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods that was not necessary for testing their quality, characteristics, and functionality.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to the delivery of goods that are made to customer specifications or clearly tailored to personal needs, to the delivery of audio or video recordings or software if the data carriers supplied have been unsealed by you, or to sealed goods that are not suitable for return for reasons of health protection or hygiene and whose seal has been removed after delivery.
Note: Individual strap adjustments made upon separate customer request by email are provided as a complimentary courtesy service outside the standard right of withdrawal and do not constitute a separate exclusion from withdrawal.
Extended Return Policy (30 Days)
In addition to your statutory 14-day right of withdrawal, we voluntarily grant you an extended return period of 30 days in total from receipt of the goods. This goodwill arrangement is in addition to the statutory right of withdrawal and does not limit it in any way. Further details are set out in our Refund Policy.
§ 9 Warranty
The statutory warranty provisions apply. If Swiss Military grants a warranty in addition, the details are set out in the warranty conditions enclosed with the goods. Warranty claims exist independently of statutory warranty rights.
§ 10 Liability
(1) Swiss Military is liable without limitation for intent and gross negligence, as well as under the provisions of the Product Liability Act and for damages arising from injury to life, body, or health.
(2) For slight negligence, Swiss Military is only liable in the event of a breach of a material contractual obligation (cardinal obligation), the fulfillment of which enables the proper performance of the contract in the first place and on the observance of which the customer may regularly rely. In this case, liability is limited to foreseeable damage typical for the contract.
(3) Otherwise, liability for damage caused by slight negligence is excluded.
(4) There is no liability for the use of the online shop being uninterrupted, timely, secure, or error-free at all times, unless this is already covered by the preceding paragraphs.
§ 11 Data Protection
Personal data is processed exclusively for the purpose of processing the respective order and within the framework of statutory requirements, in particular the General Data Protection Regulation. Details are set out in the separate privacy policy.
§ 12 Applicable Law, Jurisdiction, Contract Language
(1) Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the consumer has their habitual residence in a member state of the European Union, the mandatory consumer protection provisions of the law of that state remain unaffected by the above choice of law, insofar as they grant the consumer greater protection.
(3) The place of jurisdiction for all disputes arising from or in connection with this business relationship is, to the extent legally permissible, Solothurn, Switzerland. Swiss Military is also entitled to sue at the customer's general place of jurisdiction.
(4) The contract language is German.
§ 13 Alternative Dispute Resolution
The EU Commission provides a platform for online dispute resolution, available at https://ec.europa.eu/consumers/odr. Swiss Military does not participate in dispute resolution proceedings before a consumer arbitration body and has not submitted to any codes of conduct.
§ 14 Final Provisions
(1) Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
(2) The customer may only assign claims arising from the contractual relationship to third parties with the prior consent of Swiss Military. This does not apply to monetary claims of the customer if Swiss Military has no legitimate interest in the exclusion of assignment, or if the customer's interest in assignability outweighs Swiss Military's interest.
